What is “illegal” status under American immigration law? Illegal isn’t simply a matter of documents or passports or visa stamps. The complexity of the legal system is notorious and does not easily translate to clearly defined categories that answer the question. Beginning a policy conversation by appealing to the rule of law is, far too often, simply a way of avoiding hard questions. We assume the law has answers to our questions, though we don’t question the law itself. We simply feel comfortable throwing up our hands and saying, “Just get in line.
Do it the legal way.”
